We, Immolombard Consulting & Marketing Services Kft. (“Immolombard”), inform you how we process your personal data and what rights you have under data protection law. The content and scope of the specific data processing depends on the products and services you have requested or agreed with you.

Immolombard has taken the necessary organizational and technical measures to ensure the security of your data. The data security measures are state-of-the-art. All Immolombard employees are bound to secrecy as part of their contractual employment relationship. The same applies to all of our processors (especially software companies and other cooperation partners).
This information describes how Immolombard processes your personal data, how it ensures the security of your data and how you can contact us if you have any questions or suggestions about how we handle personal data.

Processed Data

In connection with your respective business activity, Immolombard processes personal data from the groups of people listed below. Insofar as these groups of people are legal entities, Immolombard processes the personal data of the employees responsible for our business relationship, executive officers (in particular managing directors and board members) or other representatives.

As part of an ongoing business relationship with us, you must provide the personal data that is required for the establishment and implementation of the business relationship and that we are legally obliged to collect. If you do not provide us with this data, we usually have to refuse to conclude the contract or execute the order, or we can no longer perform an existing contract and we will consequently have to terminate it.

If we also ask you to provide your data, this is basically voluntary. However, various processes of our support and information and event management as well as internal and external communication in these matters will be delayed or even impossible if you do not provide your personal data. However, if you have given us your consent to use your data beyond the contractual purposes or legal obligations, in particular to send you information about events, deadlines and other interesting information you can revoke your consent at any time.
The information on this website applies exclusively to interested parties.

Interested Persons

In the context of a possible business relationship, Immolombard processes the personal data that the interested parties themselves provide, in particular via the contact form on the website www.immolombard.com/contact (name, e-mail address, telephone number and personal information from the free fillable message text), as well as the contact data and data on the respective request otherwise transmitted to Immolombard. This data is forwarded to the partners cooperating with Immolombard.

If no business relationship is created and you have not given your consent, Immolombard will delete mere prospect data 7 months after it was recorded. However, if you have given Immolombard your consent to use your data beyond the contractual purposes or legal obligations, Immolombard will store the data until revoked and use it depending on the scope of the consent formula. You can revoke any consent you have given at any time.

The justification for this processing lies in Immolombard's obligation to fulfill (pre-) contractual obligations towards the interested party (Art 6. Para. 1 lit. b GDPR) or in the case of storage of the data after termination or if it does not come about a further business relationship on the overriding interest in accordance with Article 6 Paragraph 1 lit. f GDPR or on any consent given in accordance with Article 6 Paragraph 1 lit. a GDPR.

As part of our activities, we cooperate with companies and people who provide a wide variety of services to us or to our customers ("service providers"). This notice applies to service providers, their employees or officers and other representatives who are in contact with us on behalf of the service provider.

Legal basis of processing

To fulfill (pre-)contractual obligations (Art. 6 Para. 1 lit. b GDPR).
We process your personal data insofar as this is necessary to carry out the contracts concluded with you, in particular for the Immolombard information platform.
In order to fulfill legal obligations to which we are subject, this is in accordance with Article 6 (1) (c) of the GDPR.
We also process the personal data received to comply with regulatory obligations. These result, among other things, from:
- General Data Protection Regulation (GDPR)
- Data Protection Act (DSG)
- Due to overriding legitimate interests according to Art. 6 Para. 1 lit. f GDPR.

The overriding legitimate interest of Immolombard exists in particular in the following cases:
- Measures to prevent and combat fraud: the legitimate interest is to protect our property and the property of our cooperation partners;
- To make our homepage more user-friendly and to prevent possible attacks;
- internal evaluations to determine market opportunities and customer potential;
- or proof to third parties that you have obtained a declaration of consent relevant to the third party.

Purposes of processing

Your data will be processed for the following purposes:
- Information and support for those interested in equity release financing;
- Provision of services and products offered on our website;
- Securing the functionality of the website, including the related services and information;
- Creation of usage statistics;
- Maintaining customer and prospect directories;
- Processing of inquiries from prospects and customer orders;
- Deter/prevent identity theft, i.e. the fraudulent use of your identity;
- Detection, defense and investigation of attacks on/against our website;
- display of personalized page suggestions;
- general improvement of our service;
- Fulfillment of other legal obligations.

Transmission of your personal data

Insofar as this is necessary for the purposes mentioned above, or we have been explicitly commissioned or authorized by you to do so, we will transmit your data to the following recipients:
- our cooperation partners;
- external IT service providers, insofar as they require the data to fulfill their respective service;
- legal consulting professions;
- public arbitration boards, courts and administrative authorities.

All processors are contractually obliged to treat your data confidentially and only process it within the scope of the provision of services.

Storage duration
​
In principle, the data processed by us will be stored until the consent is revoked. In addition, we will use your above-mentioned data for the stated purposes for the duration of the business relationship (from initiation to processing to the termination of a contract, to the end of relevant limitation periods, statutory retention periods or any legal disputes in which the data is required as evidence are stored) as well as in accordance with the legal storage and documentation obligations. These result, among other things, from:
- the Corporate Code,
- and the Hungarian Fiscal Code

In addition, the statutory limitation periods, which can be up to 30 years according to the General Civil Code in certain cases (the general limitation period is 5 years), as well as guarantee and warranty periods, must also be taken into account with regard to the storage period. As soon as the legitimate purposes cease to apply, we will delete the data.

Your rights in relation to personal data

Under applicable law, you have the right, among other things,
- to check whether and what personal data we hold about you and to receive copies of that data;
- to request the correction, addition or deletion of your personal data that is incorrect or not processed in accordance with the law;
- to ask us to restrict the processing of your personal data;
- to object, in certain circumstances, to the processing of your personal data or to withdraw any previously given consent for the processing, whereby such a withdrawal will not affect the lawfulness of the processing until the withdrawal;
- request data portability;
- to know the identity of third parties to whom your personal data is transmitted and to lodge a complaint with the data protection authority (www.naih.hu) or a supervisory authority of another EU member state, in particular where you live or work to raise.

Withdrawal of consent
​
Any consent given to us in connection with the processing of personal data can be revoked at any time (in writing and electronically). It is stated that the revocation applies ex nunc, which means that the data processing that has already taken place on the basis of the consent remains unaffected. However, Immolombard adheres to the deletion obligations in accordance with Art. 17 GDPR.

Contradiction
​
We would like to point out that you have the right, for reasons arising from your particular situation, to object at any time to the processing of personal data relating to you, which we process on the basis of overriding interests; this also applies to profiling based on these provisions. Immolombard then no longer processes this personal data unless it can demonstrate compelling legitimate grounds for processing that outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.
If personal data is processed in order to operate direct advertising, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising.
